TNVAT Monthly Return Filing

Every dealer who is liable to pay tax under this Act shall file return on or before 20 th of the succeeding month to Assessing authority in  whose jurisdiction the principal place of business is located along with statement of purchases and sales effected by him during the month in the Form specified in Rules.
Every dealer whose taxable turnover in the preceding year is Two hundred crores of rupees and above shall file return on or before 12 th of succeeding month along with statement of purchases and sales effected by him during the month.
The returns shall be filed either electronically or by ICR forms.  The returns so filed shall be accompanied with proof of payment. The category of dealers to file returns either electronically or by ICR forms may be notified by the Commissioner as per VAT rules.

    Here, the meaning of “taxable turnover” , whether it represents VAT sales only or includes CST sales, export sales also ?

    Kindly clarify with reference to relevant Section / Clarification /Circular .

  2. Dear Sir,

    As per Section 2(38) of the TNVAT act, “taxable turnover” means the turnover on which a dealer shall be liable to pay tax as determined after making such deductions from his total turnover and in such manneer as may be prescribed”.

    As per section 2(40) of the TNVAT act, “total turnover” means the aggregate turnover in all goods of a dealer at all places of business in the state, whether or not, the whole or any portion of such turnover is liable to tax”

    Prima facie, from the above, we can construe as follows :-

    1) The term “total turnover” means the turnover at all places “IN THE STATE” only.
    2) In view of the above, i am of the opinion that it will include only VAT sales.
